Terms of Service

These Terms of Service (“Terms”) govern your use of Speakfect, an AI-powered public-speaking coaching service offered through our mobile and web applications (collectively, the “Service”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Speakfect. You are responsible for the accuracy of the information you provide at signup, for safeguarding your credentials, and for all activity that occurs under your account.

2. The Service

Speakfect lets you record speech, receive AI-generated transcription, scoring, and coaching feedback, run targeted drills, generate goal plans, and chat with an AI coach about a session. Features and limits depend on your subscription tier (see Section 4) and may change from time to time.

3. Acceptable use

You agree not to:

  • Record any person without their knowledge and consent where consent is required by law.
  • Upload or transmit content that is unlawful, hateful, defamatory, threatening, sexually explicit, or that infringes another person’s rights.
  • Use the Service to harass or impersonate any person.
  • Reverse engineer, decompile, scrape at scale, or attempt to derive the source code of the Service, except to the extent applicable law expressly permits.
  • Resell, sublicense, or commercially exploit the Service or its AI-generated outputs without our written permission.
  • Interfere with the Service’s operation or attempt to gain unauthorized access to any part of it.
  • Use the Service to develop a competing product or to train a competing AI model.

4. Subscriptions and payments

Speakfect offers a Free tier and a Premium tier (available as Monthly and Annual plans). Premium subscriptions are sold and billed by Apple App Store or Google Play Store and are governed by the applicable store’s terms.

  • Subscriptions auto-renew at the price and interval shown at checkout until you cancel.
  • Cancel at least 24 hours before the next renewal through your App Store or Play Store account settings.
  • Refunds are handled by the applicable store under its refund policy.
  • Prices, features, and free-tier limits may change with reasonable notice; changes apply only to renewals after the notice period.

5. Your content

You retain ownership of the audio, video, transcripts, and other content you submit to the Service (“Your Content”). You grant Speakfect a worldwide, non-exclusive, royalty-free license to host, transmit, process, and display Your Content solely as needed to operate the Service for you, including by sending it to our AI processing sub-processors as described in our Privacy Policy. We do not claim ownership of Your Content and we do not use it to train third-party machine-learning models.

6. AI-generated output

Coaching feedback, scores, transcripts, suggested questions, and goal plans produced by the Service are generated by AI models and may contain errors, omissions, or judgments that differ from a human coach. They are provided for your personal practice and improvement and are not professional advice (career, medical, legal, or otherwise). You are solely responsible for any decision you make based on AI-generated output.

7. Intellectual property

The Service, including its software, designs, logos, and text (other than Your Content), is owned by Speakfect or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes consistent with these Terms.

8. Third-party services

The Service relies on third-party providers including Clerk (authentication), Google Gemini (AI processing), RevenueCat (subscription orchestration), Apple and Google (in-app purchases), and Sentry (diagnostics). Your use of these providers is also subject to their respective terms; we are not responsible for their acts or omissions.

9. Termination

You may stop using the Service at any time and may delete your account from Profile → Account → Delete account. We may suspend or terminate your access if you violate these Terms, if your account is inactive for an extended period, or if we discontinue the Service. Sections that by their nature should survive termination — including ownership, disclaimers, indemnity, limitation of liability, and dispute resolution — will survive.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Speakfect does not warrant that the Service will be uninterrupted, error-free, secure, or that AI-generated output will be accurate or suitable for any particular purpose.

11. Limitation of liability

To the maximum extent permitted by law, Speakfect and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or opportunities, arising out of or relating to your use of the Service. Our total aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or (b) USD $50.

12. Indemnification

You agree to defend, indemnify, and hold harmless Speakfect and its officers, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) Your Content, (b) your violation of these Terms, or (c) your violation of any rights of another person.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable consumer-protection rights you have under the laws of your place of residence.

14. Changes to the Service or these Terms

We may modify the Service or these Terms at any time. For material changes to the Terms, we will update the “Last updated” date above and give you notice in the app or by email before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
